Halle Berry is seeking sole legal custody of the son she shares with ex-husband Olivier Martinez, claiming his “unruly” behavior has negatively impacted the 10-year-old.
The Oscar-winning actor, 58, claims his son Maceo suffers from severe behavioral and learning issues that his father refuses to address, according to new legal documents obtained by TMZ.
The filing, which highlights the impact Martinez’s “harmful behavior” had on Maceo, comes nearly a year after the couple settled their contentious divorce last August — nearly eight years after their 2015 split.
The “Union” star claims in the filing that her son is falling behind in his studies, largely because his father emphasizes football over school. She also says Maceo comes back to her angry and aggressive after spending long periods of time with Martinez.
Berry implored the judge to grant her full custody so she could make decisions about Maceo’s education and therapy on her own.
Berry says she spent hundreds of thousands of dollars trying to reach a deal with Martinez behind closed doors, but now feels she has no choice but to file the legal documents publicly, according to TMZ.
Berry and the César Award-winning French actor were married for two years before filing for divorce in October 2015, citing irreconcilable differences. Despite rumors that they later put the proceedings on hold and tried to work things out, the former spouses were declared single in late 2016.
In 2020, news broke that Berry intended to represent herself in the lengthy divorce case.
As part of the deal reached last August, Berry agreed to pay $8,000 a month in child support and said she would pay for Maceo’s private school tuition, supplies and all extracurricular activities. The agreement also included a family counseling plan to help with the difficult co-parenting situation.
Before Martinez, Berry was in a five-year relationship with Canadian model Gabriel Aubry, with whom she had a teenage daughter, Nahla.
She was also married to former Yankees left fielder David Justice from 1993 to 1997, as well as R&B singer Eric Benét from 2001 to 2005.
